This STALLION BREEDING CONTRACT FOR TRANSPORTED COOLED SEMEN for the breeding season of 2008 made and entered into on this _____________day of ______________, 20__.  This certifies _____________________________________, herein referred to as MARE OWNER, has engaged one service to RAISE THE TRIPLE BAR APHA# 679,530, for the mare ______________________________ - registration # (if applicable), ______________, APHA – AQHA – PtHA – IAHA – TB (circle one), for the Stud Fee of $________, to be bred to RAISE THE TRIPLE BAR, APHA # 679,530. Raise the Bar Farms, Michael and Sharon Chambers, will herein be referred to as STALLION OWNER.

1.      The Stud Fee includes a non-refundable booking fee of $200.00, due and payable with this contract.  The second payment of $200.00 is due no later than 60 days after receiving the first shipment of semen.  The balance of $ ___________________ is due no later than November 1, 2008.

2.      A photo copy of the mare’s registration papers, and a recent (60 days or less) veterinarian certificate stating a negative uterine culture MUST be on file with the Breeder prior to requesting semen.  Mare owner claims that the mare is current on all necessary vaccinations and worming and that mare is in sound breeding condition as far as can be reasonably ascertained.

3.      Mare owner agrees to vaccinate mare against Rhinopneumonitis at her 5^th, 7^th, and 9^th month of gestation.  Failure to do so may result in the loss of said pregnancy and void live foal guarantee.

COOLED SHIPPED SEMEN FEES and PROCEDURES

  First collection is included in stud fee, subsequent collections will be $150.00, which will need to be paid prior to shipment.  At the time of booking, you may send an additional check that will be attached to your file to be deposited when you call and are ready for your shipment.   Each shipment will give you enough semen to inseminate one mare two times.  You will need to set up your own account with FedEx.  You can save 10% on the shipping fees by opening your own account on-line at www.fedex.com or by calling 1-800-Go-FedEx.

4.      Our regular collection days are Monday thru Friday.

a.      SATURDAY emergency collection calls will be charged at a rate of $25.00 each collection over and above the regular scheduled fee. .

5.      MARE OWNER MUST, WITHOUT FAIL, NOTIFY US THE DAY THE MARE COMES INTO HEAT!  Some mares take longer to reach ovulation- so keep us informed of progress of cycle.

6.      Mare owner agrees to have a licensed veterinarian or certified tech inseminate mare immediately upon receiving shipment.

7.      Mare owner further agrees to complete the semen forms provided by APHA via the Breeder.

a.      COOLED SEMEN TRANSPORTATION AND INSEMINATION REPORT.

8.      The pre-printed Breeders Certificate will be mailed to the mare owner once they are made available thru the APHA, pending receipt of all fees.

9.      The most important part of a successful breeding season is communication.  Please let us know where your mare is in her heat cycle so we can be prepared on our end to fill your request in a timely fashion. RAISE THE BAR FARMS must receive request for semen by 5p.m. Pacific Standard Time the day prior to shipment.  Upon completion of this contract, and with the proper notice, the Breeder agrees to provide the Mare Owner with LIVE VIABLE COOLED SEMEN.

10.  Unless otherwise instructed, we supply a disposable high quality cooled shipped semen container that you can purchase for $30.00.  You will not need to return it.  (semen has been shipped to Australia in this container with excellent results.)

11.  If said mare should fail to conceive on the first breeding attempt semen may be reordered.  The collecting and preparation fee of $150.00 will apply.

12.  If, after 3 consecutive breeding attempts the mare named above still fails to conceive, the Breeder requires a uterine biopsy be done to determine the condition of the mares uterus before any further shipments will be made. (At this time, mare owner has option to substitute another approved mare)

13.  If said mare should die, fail to conceive or prove to be unfit to deliver a live foal, Mare Owner has the right to substitute an approved mare.  NO monies will be refunded IF Mare Owner decides to quit trying to breed above named mare, or the approved substitute.

LIVE FOAL GUARANTEE

14.  IF AFTER BEING PRONOUNCED SAFE IN FOAL, the mare should miscarry, abort, or prove barren, the Mare Owner may request semen again during the current breeding season: Feb. 1, 2008 – July 1, 2008; or, may return the next calendar breeding year.  No booking fee is required for return service. All normal collecting / preparation and shipping fees will apply.

15.  A LIVE COLORED FOAL is described as a newborn foal with sufficient white to qualify for REGULAR APHA Registry, which stands and nurses without assistance and survives the first 72 hours.  IF the foal is not a colored foal, ie. SOLID, there are return privileges. NO BOOKING or BREEDING fee for the 2009 breeding season ONLY. (There will be a $100.00 handling fee).  All normal collecting/preparation and shipping fees will apply.  If you choose not to exercise your REBREED privilege then we will consider this contract completed.

16. RAISE THE TRIPLE BAR is an American Paint Horse with an Overo coat pattern.  There is a 1 in 4 chance that breeding an Overo to another Overo, or any other horse with a lethal white gene (OLWS), will result in a lethal white foal. 17.  This contract is entered into in the State of California and will be interpreted and enforced under the laws of that state.  If any clause of this contract is against State Laws then that clause shall be null and void.

18.  This contract represents the entire agreement between the parties.  No other agreements, promises, verbal or implied unless specifically stated in this written contract.  When the above named Mare Owner signs and returns the contract with the booking fee to the Breeder it will then be a binding contract on both parties, subject to the above terms and conditions.  This contract is not valid unless completed in full.

19.  This contract is for COOLED SHIPPED SEMEN ONLY.

20.  All collection, preparation and shipping fees are for services rendered and are NOT REFUNDABLE UNDER ANY CIRCUMSTANCE.

21.  This contract is non-transferable and non-assignable.
